Terms of Service
These Terms of Service ("Terms") govern your access to and use of Kura — this website and the Kura app on iOS and Android (together, the "Service"), operated by Parlad Dhungana ("Kura," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use Kura.
1. Acceptance of these Terms
By creating an account, downloading, installing, or otherwise using Kura, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using Kura on behalf of someone else, you confirm you are authorized to accept these Terms on their behalf. If you do not agree to these Terms, you must not use the Service.
2. Who can use Kura
You must be at least 13 years old to create a Kura account. If you are under the age of majority where you live, you may only use Kura with the involvement and consent of a parent or legal guardian. Kura is not directed at children under 13, and we do not knowingly allow anyone under 13 to create an account or submit content.
3. Getting Kura through the App Store or Google Play
Kura is made available to you through the Apple App Store and Google Play. Downloading, installing, and using Kura through either store means you are also bound by that store's own terms — Apple's Licensed Application End User License Agreement (or the applicable Apple Media Services Terms and Conditions for your country) and/or Google Play's Terms of Service, as applicable. If there is a conflict between these Terms and the applicable app store's terms regarding your use of the Service, the app store's terms govern to the extent required for your access through that store.
Apple and Google are not responsible for Kura, its content, or these Terms, and have no obligation to provide maintenance or support for Kura. To the extent required by their respective terms, Apple and Google are third-party beneficiaries of these Terms and may enforce them against you in connection with your use of Kura on their platform.
4. What Kura is
Kura is an informational and community app for Nepal and the Nepali diaspora — the Bikram Sambat calendar and panchang, live Nepali radio, currency exchange information, personal notes, and a community map, built so our community can stay connected to home and to each other. Kura is a tool to help people share information and support one another; it is not a news outlet, financial advisor, religious authority, or emergency service, and nothing in the Service should be relied on as professional, legal, financial, medical, or astrological advice.
5. Your account
Some features — notes, favourite radio stations, and community posts — require an account. You sign in using Google or Apple; Kura relies on those providers to verify your identity and never sees or stores your Google or Apple password. You're responsible for keeping your device and sign-in secure and for all activity under your account. If you believe your account has been accessed without your permission, tell us right away at admin@nepalikura.app.
6. Acceptable use
Kura exists to help our community, not to host harm. When you use Kura, you agree that you will not, and will not help or permit anyone else to:
- Use the Service for any illegal purpose, or in a way that violates any applicable local, provincial, national, or international law or regulation;
- Harass, bully, stalk, threaten, defame, or exploit any other person — including any form of sexual harassment or exploitation;
- Post, share, or transmit hate speech, or content that incites violence, promotes discrimination, or threatens any person or group based on race, ethnicity, caste, religion, gender, sexual orientation, disability, nationality, or any other protected characteristic;
- Create, upload, share, request, or solicit any content that sexualizes, exploits, endangers, or otherwise harms a child, or exploits any other vulnerable person, in any way, for any reason — this is never permitted, without exception;
- Impersonate any person or entity, or misrepresent your affiliation with one;
- Upload or transmit viruses, malware, or code designed to interrupt, damage, or limit the Service or any connected system;
- Attempt to gain unauthorized access to the Service, other users' accounts, or any connected systems or networks;
- Scrape, data-mine, or use automated means to access or collect data from the Service without our prior written consent;
- Reverse-engineer or decompile the Kura app, except where applicable law expressly permits it;
- Post spam, unauthorized advertising, or content that infringes someone else's intellectual property or other rights; or
- Use the community map or any other feature to share someone else's private information without their consent, or to coordinate harassment, illegal activity, or harm against any person or place.
7. Reporting content or accounts
If you see a post, photo, comment, community-map entry, or account on Kura that you believe violates these Terms — including harassment, hate speech, impersonation, or content endangering a child or other vulnerable person — please report it to us right away at admin@nepalikura.app. Please include as much detail as you can (such as the username, the content in question, and why you're reporting it) so we can review it quickly.
We review reports and take the action we consider appropriate, which may include removing content, warning a user, or suspending or terminating an account, consistent with Section 6 (Acceptable use) and Section 13 (Suspension, termination, and reinstatement). We may not be able to share the outcome of every report due to privacy considerations, but we take every report seriously.
8. Your content
Notes, community posts, photos, and anything else you submit through Kura ("User Content") remain yours. By submitting User Content, you grant Kura a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display it solely to operate and improve the Service — for example, showing your post on the community map or syncing your notes across your devices. You are responsible for your User Content and confirm you have the right to share it and that it does not violate these Terms or the law. We may remove or restrict access to any User Content, without notice, if we believe in good faith it violates these Terms or applicable law.
9. Third-party content and services
Kura streams live radio from independently operated stations (such as Kantipur, Radio Nepal, and Kalika) using their own public broadcast feeds; Kura does not host, control, or take responsibility for that content. Currency exchange rates, panchang data, and news headlines shown in the app are provided for general informational purposes and may not always be current or exact — please verify independently before relying on them for financial, legal, medical, religious, or other significant decisions.
10. Links to third-party websites
Kura may contain links to, or otherwise direct you toward, third-party websites, services, or content that Kura does not own or control — for example, a radio station's own website, a news source, or a link shared within a community post. We provide these links for your convenience only. Kura is not responsible for, and does not endorse, the content, accuracy, products, services, privacy practices, or terms and conditions of any third-party website or service. You access any third-party site at your own risk, and we encourage you to review that site's own terms and privacy policy before using it.
11. In-app purchases and subscriptions
The core of Kura — the Bikram Sambat calendar, panchang, currency and forex information, live radio, and up to 3 personal notes — is free to use. Kura also offers an optional paid subscription, Kura Pro (together with any other paid add-ons Kura may offer, "Paid Features"), which adds calendar sync across your devices, background music playback for the radio, unlimited personal notes, and an ad-free experience. Where Paid Features are offered, the following applies:
- Pricing and billing cycle — the price, currency, and billing frequency (such as monthly or annual) for Kura Pro are shown to you in the app before purchase, through the Apple App Store or Google Play. Prices may vary by region and are subject to change with notice as required by applicable law and the relevant app store's policies.
- Payment — all payments are processed by Apple or Google, not by Kura directly. Kura does not receive or store your payment card details.
- Automatic renewal — unless you cancel before the end of the current billing period, Kura Pro automatically renews for the same period at the then-current price, and the payment method you have on file with Apple or Google will be charged automatically.
- Cancellation — you can cancel Kura Pro at any time through your Apple ID account settings or your Google Play account settings, as applicable. Cancelling stops future renewals but does not refund the current billing period unless otherwise required by law or the applicable store's policy. Your access to Kura Pro generally continues until the end of the period you already paid for.
- Refunds — refund requests are handled by Apple or Google under their own refund policies, not by Kura directly, because purchases are made and billed entirely through their platforms.
- Free trials or introductory offers — where Kura offers a free trial or an introductory price for Kura Pro, the terms of that offer, including when and how it converts to a paid subscription, will be disclosed to you at the time of the offer.
12. Intellectual property
The Kura name, logo, app design, and all content we create (excluding User Content and third-party streams) belong to Kura or its licensors and are protected by copyright, trademark, and other laws. These Terms grant you only a limited right to use the app for its intended personal purpose — nothing here gives you any right to our name, branding, or content.
13. Suspension, termination, and reinstatement
Kura reserves the right, at our sole discretion and at any time, to suspend, restrict, or permanently delete any account, and to remove any User Content, with or without notice, if we believe an account or its content violates these Terms, applicable law, or puts other users, Kura, or third parties at risk. Kura also reserves the right to reinstate a suspended or deleted account at our discretion. You may stop using Kura and request deletion of your account at any time by writing to admin@nepalikura.app — see our Privacy Policy for what happens to your data when you do.
14. Changes to these Terms
Kura reserves the right to update these Terms at any time to reflect changes to the Service, our practices, or the law. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, give additional notice in the app — for example, through an in-app notice or a message to the email address on file. Continuing to use Kura after a material change takes effect constitutes your acceptance of the updated Terms. If you do not agree with a change, you must stop using the Service; you may also request deletion of your account as described in Section 13 (Suspension, termination, and reinstatement).
15. Compliance with local laws
You're responsible for using Kura in compliance with the laws and regulations of the country and region you access it from. Some content or features may not be appropriate or lawful everywhere; if a feature of Kura is unlawful where you are, you must not use that feature.
16. Disclaimers
Kura is provided "as is" and "as available," without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee the Service will be uninterrupted, secure, or error-free, or that panchang, currency, or news information will always be accurate or current.
17. Limitation of liability
To the fullest extent permitted by law, Kura and its founders, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of, or inability to use, the Service — even if we've been advised such damages were possible. Nothing here limits any liability that cannot be limited under applicable law.
18. Indemnification
You agree to indemnify and hold harmless Kura and its founders, employees, and partners from any claim, demand, loss, or damages, including reasonable legal fees, arising from your use of the Service, your User Content, or your violation of these Terms or any law.
19. Enforcement and legal action
Kura takes misuse of the Service seriously. If you steal, misuse, hack, scrape, or otherwise unlawfully access Kura, our data, our users' data, or our intellectual property — or use the Service to break the law, harass or endanger others, or infringe someone else's rights — Kura reserves the right to investigate, suspend or terminate your access, and pursue every legal remedy available to us. This includes civil claims for damages, injunctive relief, referral to law enforcement or regulators, and, where appropriate, criminal prosecution. We may cooperate with law enforcement and comply with valid legal process, including to identify a user we reasonably believe is engaged in unlawful activity.
20. Governing law and disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable in it, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the courts of Nova Scotia, Canada, and you consent to that jurisdiction and venue.
21. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest remains in full force and effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Kura about the Service.
